§ 15-22. Prohibition on the sale or other transfer of animals in certain restricted areas, exceptions, penalty.

  • (a)

    Prohibition. No person shall sell, exchange, barter, trade, lease, rent, give away, display or transfer any animal on any roadside, public right-of-way, parkway, median, park, playground, flea market, commercial or retail parking lot, or property adjacent to such locations, that is generally accessible to the public, regardless of whether such access is authorized or not.

    (b)

    Exceptions. This section shall not apply to bona fide humane societies, animal welfare groups, animal control agencies, or other nonprofit organizations sponsoring animal adoption events, or to sales or other transfers from a personal residence. Further, this section shall not apply to outdoor sales of livestock, poultry, fowl, or rabbits by licensed retailers on such retailer's premises (e.g., sidewalk sales of chicks by licensed hardware or feed stores).

    (c)

    Penalty. Whoever commits a violation of this section shall be guilty of a misdemeanor and shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) or imprisonment for a term not exceeding six months, or both such fine and imprisonment.
