§ 19-29. Notice to owner of needed repairs; application for repairs by parish engineer; costs.

  • When any cattle gap situated and lying across a parish road is found by the parish engineer to be in such a state or condition as to be a potential hazard to vehicular traffic on the road involved because of potential danger to life and property, the parish engineer shall forthwith, by certified mail, give notice to the adjacent land owner for whose benefit the cattle gap [exists], outlining the repairs needed and indicating the costs thereof based on the current labor costs and material costs; the notice should also contain provisions that the owner affected may make application to the parish engineer within ten (10) days to have the cattle gap repaired. The application shall be accompanied by a deposit of cash or a bank money order, or cashier's check made payable to the Ouachita Parish Police Jury in the amount of the estimated cost of repairs. Upon receipt of the application properly executed accompanied by the deposit hereinabove set forth, the engineer shall have authority to forthwith proceed to repair the cattle gaps paying the costs thereof from the deposit hereinabove set forth; an accounting of the costs of repairs and disposition of the deposit shall be rendered to the police jury and to the applicant.
