§ 1-128. Sick leave.

  • (a)

    Sick leave is defined as any period of time during which an employee may be excused from work without loss of pay due to:

    (1)

    Personal illness, injury or any other type of physical disability, except injuries incurred on the job; (job-related injuries are covered under workmen's compensation. See "Disability," section 1-135).

    (2)

    Dental appointments.

    (3)

    Serious illness in the employee's immediate family. For the purpose of this section, the immediate family shall be deemed to include parents, spouse, children, brothers, sisters, immediate in-laws, and grandchildren of the employee.

    (b)

    Sick leave shall be credited to a permanent full-time employee upon the completion of the following periods of service:

    Six (6) months .....4 days

    One (1) year .....4 days

    Two (2) years .....8 days

    Three (3) years and each year thereafter .....12 days per year

    Permanent part-time employees shall accumulate sick leave on a pro rata basis.

    (c)

    An employee on sick leave shall inform his/her supervisor of the fact and reason prior to the scheduled start of work, if possible. Failure to do so may result in denial of sick leave with pay for the period of absence. Absence for a part of a day that is chargeable to sick leave shall be charged proportionately in an amount not less than one hour.

    (d)

    Vacation leave may be used for sick leave purposes after sick leave is exhausted. Employees who have exhausted all sick leave and vacation leave credits may, at the discretion of the police jury, be granted leave of absence without pay for a period not to exceed one year.

    (e)

    If a police jury holiday occurs during such absence, the day will be considered a holiday rather than a day of sick leave.

    (f)

    An attendance record is one of the factors that will be taken into consideration in completing each employee's annual progress record for merit salary increases.

    (g)

    Sick leave may be carried forward from year to year without limitation.

    (h)

    Upon retirement, a maximum of sixty (60) days sick leave may be approved, allowed, and credited to an employee's record, and compensation allowed him at his average wage rate for the last five (5) years of service. Upon voluntary resignation or involuntary termination, an employee shall not be compensated for any accumulated sick leave benefits.

    (i)

    Employees will be allowed to carry the additional sixty (60) days into the retirement system at their (employee) own expense.

    (j)

    Each department head shall keep records of sick leave accrued, sick leave taken, and balance of sick leave for each employee. An employee fraudulently obtaining sick leave shall be subject to disciplinary action in accordance with section 1-168, "Types of Disciplinary Action."
