§ 2-1. Definitions.

For the purposes of this chapter, the following terms have the respective meanings ascribed to them in this section, except in those instances where the context indicates a different meaning:

Alcoholic beverages means any fluid, or any solid capable of being converted into fluid, suitable for human consumption, and containing more than one-half of one (0.5) percent of alcohol by volume, including malt, vinous, spirituous, alcoholic or intoxicating liquors; beer, porter, ale, stout, fruit juices, cider and wine.

Beverages of low alcoholic content means alcoholic beverages containing not more than six (6) per cent of alcohol by volume.

(2)

Beverages of high alcoholic content means alcoholic beverages containing more than six (6) per cent of alcohol by volume.

Bottle club means any establishment whereby the owner, corporation, partnership or their employees do not sell, serve, handle, dispense or store alcoholic beverages, but in which patrons are allowed to consume alcoholic beverages in the premises from the patron's own supply of alcoholic beverages.

Class A beer retail dealer shall mean any person who sells alcoholic beverages of low alcoholic content at retail for consumption on or off the licensed premises.

Class B beer retail dealer shall mean any person who sells alcoholic beverages of low alcoholic content at retail in bottles, cans or other sealed containers only and only for consumption off the licensed premises.

Class C beer retail dealer shall mean any person who sells alcoholic beverages with a content of less than 3.2 per cent by volume, in original packages and for consumption on the premises.

Class C liquor retail dealer shall mean any person who sells alcoholic beverages of high alcoholic content at retail for consumption on or off the licensed premises.

Class D beer retail dealer shall mean any person who sells alcoholic beverages with a content of less than 3.2 per cent by volume, in original packages and for consumption off the premises.

Class D liquor retail dealer shall mean any person who sells alcoholic beverages of high alcoholic content at retail in bottles, cans or other sealed containers and only for consumption off the licensed premises.

Class "R" restaurant shall mean an establishment:

(1)

Which operates a place of business whose purpose and primary function is to take orders for, prepare and serve food and food items on the premises;

(2)

Which serves alcoholic beverages in conjunction with meals;

(3)

Which serves food on all days of operation;

(4)

Which grosses sixty (60) per cent of its average monthly revenue from the sale of food and food items;

(5)

Which maintains separate sales figures for alcoholic beverages; and

(6)

Which operates a fully equipped kitchen used for the preparation of uncooked foods for service and consumption of food on the premises.

Class W winery shall mean a wine producer or winery that sells wine of an alcoholic content in excess of six (6) per cent by volume.

Dealer means any person who engages in the sale or distribution, at wholesale or retail, of alcoholic beverages within the city.

Handle means sell, use, distribute, store, consume, or otherwise handle.

Hotel-motel hospitality rooms means any room in a bona fide hotel or motel which is used for the purpose of the hospitable consumption of alcoholic beverages without charge or fee.

Manufacturer means any person who, directly or indirectly, personally or through any agency, engages in the making, blending, rectifying or other processing of alcoholic beverages in the parish.

Package house means a place where a person sells alcoholic beverages in closed containers, prepared for transportation and consumption off the premises.

Premises means a licensed establishment where alcoholic beverages are kept, sold, stored or consumed which includes the lot of the licensed establishment, but shall exclude the sidewalk, street curb and street adjacent thereto.

Retail dealer means any person who offers for sale, exposes for sale, has in his possession for sale or distribution, or sells, alcoholic beverages in any quantity to persons other than licensed wholesale or retail dealers.

Wholesale dealer means any person who sells alcoholic beverages to licensed wholesale dealers or licensed retail dealers within the parish.

Wine producer means any person who, directly or indirectly, personally or through any agency, cultivates and grows grapes, fruits, berries, honey, or vegetables from which wine of an alcoholic content in excess of six (6) per cent by volume is produced and bottled from a fermentation of such grapes, fruits, berries, honey, or vegetables in Louisiana or outside the state for shipments to licensed wholesale dealers within the state subject to the provisions of R.S. 26:364.

Winery means a plot of land located in Louisiana used to cultivate and grow grapes, fruits, berries, honey, or vegetables to produce and bottle wine of an alcoholic content in excess of six (6) per cent by volume.
