§ 2-11. Same—Qualifications of applicant.

  • (a)

    Every applicant for an alcoholic beverage license shall meet the following qualifications and conditions:

    (1)

    Is a person of good character and reputation and over eighteen (18) years of age.

    (2)

    Is a citizen of the United States and of the state and a resident of the state continuously for a period of not less than two (2) years next preceding the date of the filing of the application, provided that:

    a.

    The requirements as to Louisiana citizenship do not apply to wholesaler or retailers who held permits on or prior to January 1, 1946.

    (3)

    Is the owner of the premises or has a bona fide written lease therefor.

    (4)

    Has not been convicted of a felony under the laws of the United States or of this or any other state or country, which conviction is reasonably related to the applicant's business in Louisiana.

    (5)

    Has not been convicted in this or in any other state or by the United States or any other country of soliciting for prostitution, pandering, letting premises for prostitution, contributing to the delinquency of juveniles, keeping a disorderly place, or illegally dealing in narcotics.

    (6)

    Has not had a license or permit to sell or deal in alcoholic beverages, issued by the United States, by any state, or by any political subdivision of any state authorized to issue permits or licenses with respect to alcoholic beverages, revoked within two (2) years prior to the application, or been convicted or had a judgment of court rendered against him in a case involving alcoholic beverages by the courts of the city or any other political subdivision of this or any other state, or the United States for two (2) years prior to the application.

    (7)

    Has not been adjudged by any alcoholic beverage control board of this state to have violated, or been convicted by any court of violating, any of the provisions of this chapter or of the alcoholic beverage control laws of this state or of the alcoholic beverage control laws or ordinances of any other state or political subdivision.

    (8)

    Is not delinquent in the payment or remittance of sales, use, occupational or any other tax, license, fee, etc., due the parish.

    (b)

    If the applicant is a partnership or anyone in partnership with or financed by another, all members of the partnership or all the persons in any way financially interested in the business shall also possess the qualifications required of an applicant. The applicant shall state the full names and proper residence addresses of all partners and persons financially interested; and each shall furnish his affidavit showing his qualifications, as required of an applicant.

    (c)

    If the applicant is a corporation, it shall be either organized under the laws of the State of Louisiana or qualified to do business within this state; and all officers and directors and all stockholders owning in the aggregate more than five (5) per cent of the stock and the person or persons who shall conduct or manage the business shall possess the qualifications required of an applicant to be shown by the affidavit of each accompanying the application, provided that:

    (1)

    If the corporate applicant was the holder of a permit from the parish on December 31, 1971, the officers, directors and stockholders shall not be required to meet the requirements of citizenship and residence in the state.

    (2)

    With respect to applications for retail permits only, the officers, directors and stockholders shall not be required to meet the requirements of citizenship and residence in the state.

    (d)

    If the applicant's business is to be conducted wholly or partly by one (1) or more managers, agents, servants, employees or other representatives, that person shall also possess the qualifications required of the applicant, to be shown by the affidavit of each accompanying the application.

    (e)

    If the applicant, or any person required to have the same qualifications, does not possess the required qualifications, the permit may be denied.

    (f)

    If the applicant, or any other person required to have the same qualifications as the applicant or the predecessor in business of such applicant or other person, is delinquent in the payment or remittance of any sales, use, occupational or other tax, license, fee, etc., due the parish, the application for permit shall be denied unless the police jury, in its discretion, has consented to a partial and/or installment repayment of the delinquency, in which case the permit may be issued conditioned upon the applicant's compliance with the terms of said agreement.
