§ 2-30. Additional qualifications for Class "R" restaurant establishment license.

  • (a)

    In addition to the other requirements set forth in this chapter, an applicant for a Class "R" restaurant establishment license shall attach to its application:

    (1)

    Proof of issuance of a retail dealer's license for on-premises consumption of alcoholic beverages (of high or low content) from the parish (or contemporaneous application for such license); and

    (2)

    An affidavit establishing that the applicant is a restaurant establishment and the establishment grosses sixty (60) per cent of its average monthly revenue from the sale of food and food items, which affidavit is supported by copies of actual business records, including sales records, sales tax receipts, receipts for purchases of food, food items and alcoholic beverages.

    (3)

    For new restaurant establishments without prior business experience on which to determine the gross revenue from the sale of the items as set forth in subsection (2) above, the affidavit provided in subsection (2) shall provide that based upon the reasonable expectation of applicant, the establishment will meet the requirement, and the Class "R" restaurant establishment license granted shall be considered as temporary and shall be subject to the express condition that the necessary documentation as set forth in subsection (2) above shall be submitted prior to the expiration of a sixty-day period from the grant of the license, or the license shall automatically expire.

    (4)

    Failure of an establishment to continue to meet the requirements of a "restaurant establishment" shall be sufficient grounds for immediate suspension of the Class "R" restaurant establishment license.

    (5)

    If an applicant for a Class "R" restaurant establishment license is the holder of a retail dealer's license for on-premises consumption of alcoholic beverages from the parish, the parish may issue the Class "R" restaurant establishment license upon compliance with this section, and without additional approval of the parish.
