§ 3¾-1. Regulation of cable television systems.

  • (a)

    The Ouachita Parish Police Jury is a franchising authority with the legal authority to adopt, and the personnel to administer, regulations with respect to the rates and charges of any cable television systems operating in the parish including, without limitation, the system currently being operated by Time-Warner dba Louisiana Cablevision, Inc. and Cable Management Associates dba Southwest Cablevision, Inc., pursuant to cable franchise agreements.

    (b)

    The parish desires to regulate the basic service rates and charges of Time-Warner dba Louisiana Cablevision, Inc., Cable Management Associates dba Southwest Cablevision, Inc., and other cable television systems operating in the parish and shall do so in accordance with the Cable Consumer Protection and Competition Act 1992 and rules and regulations adopted pursuant thereto by the Federal Communications Commission (FCC) (which are included herein by reference), notwithstanding any inconsistent provisions in a franchise agreement. In connection with such regulation, the parish will ensure a reasonable opportunity for consideration of the views of interested parties.

    (c)

    The President of the Ouachita Parish Police Jury or his designee, is authorized to execute on behalf of the parish to the FCC such certification and other forms as are required by FCC Rate Regulations in order to enable the parish to regulate rates and charges.
