§ 7-68. Olin Mathieson Chemical Corp., 1964 franchise.
(1)
There is hereby granted to Olin Mathieson Chemical Corporation, a corporation organized and created under the laws of the State of Virginia, its successors and assigns, a non-exclusive franchise, right and privilege to construct, operate and maintain a water pipe line or pipe lines and electrical transmission lines under, along and across certain parish roads of the Parish of Ouachita, Louisiana, along three (3) alternate routes at the approximate locations shown on the plat annexed to and made a part hereof and marked "Exhibit A" for identification, not within the limits of any incorporated city, town or village, provided that such pipe line or pipe lines shall be constructed in accordance with the construction requirements adopted by the director of highways of the State of Louisiana with respect to pipe lines laid under the state highways, and provided, further, however, that the president of the police jury may dispense with such of said requirements as, in his opinion, are not necessary or requisite, such alternate routes to consist of the following:
Alternate Route A. To include the right to cross Valley Road, Higman Street and Eby Street at the approximate locations shown in red on Exhibit A.
Alternate Route B. To include the right to cross Valley Road at the approximate location shown in red on Exhibit A; to enter Higman Street at the approximate location indicated as the southerly terminus of the blue line shown on Exhibit A or at a point northwesterly therefrom; thence extending northwesterly along Higman Street at the approximate location of the blue line shown on Exhibit A into Eby Avenue; thence extending southwesterly along Eby Avenue at the approximate location of the blue line shown on Exhibit A to the southwesterly terminus of said blue line at a point coincident with the southwesterly line of Eby Street extended across Eby Avenue.
Alternate Route C. To enter Valley Road at the approximate location indicated as the southerly terminus of the green line shown on Exhibit A; thence extending northwesterly along Valley Road at the approximate location of the green line shown on Exhibit A into Eby Avenue; thence extending southwesterly along Eby Avenue at the approximate location of the green line shown on Exhibit A to the southwesterly terminus of said green line at a point coincident with the southwesterly line of Eby Street extended across Eby Avenue;
and provided further that should grantee's facilities to be constructed under the provisions hereof be constructed along either of the routes indicated in Alternate B or Alternate C described above, same shall be constructed, where same are laid within and along the roadways, at the specific locations in such roadways as may be mutually agreed upon by the engineer for the Parish of Ouachita and the engineer for grantee, and provided further that at the turns in the pipe line or pipe lines at the southerly terminus of the blue line, or northwesterly therefrom, in Higman Street and at the intersection of Higman Street and Eby Avenue in Alternate Route B or at the southerly terminus of the green line in Valley Road and at the intersection of Valley Road and Eby Avenue in Alternate Route C, grantee may install and maintain the necessary concrete thrust blocks.

This ordinance [section] and the rights granted hereunder shall be cumulative of and complemental to the rights granted under Ordinance No. 7157 heretofore adopted by the police jury of Ouachita Parish on December 11, 1963 [being Section 7-69 hereof]; provided that upon the exercise by grantee of its rights under Ordinance No. 7157 or this Ordinance [section] and upon the determination by grantee of the route of its facilities to be constructed under the provisions of such ordinances and the completion of the construction by grantee of such facilities that all further rights of grantee hereunder or under Ordinance No. 7157 with respect to any of the routes provided for in such ordinances not theretofore exercised by grantee shall expire, cease and terminate and grantee shall execute and deliver to the police jury of Ouachita Parish a release of all rights stipulated in its favor under either and/or both of such ordinances which have not been exercised or utilized by grantee.

This ordinance [section] is issued under and by virtue of the various acts of the Legislature of the State of Louisiana, authorizing the police juries of the parishes of said state to grant franchises for the crossing of the roads and highways of the various parishes.

The grantee herein named in accepting this franchise agrees and guarantees to hold harmless the police jury of the Parish of Ouachita, Louisiana, and its individual members from any and all loss, damage or expense which they may suffer on account of the grant of this franchise and privilege and operations thereunder arising from any cause whatsoever in favor of any person, persons, partnership or corporation, and further agrees that it will repair all damages to highways, roadways or bridges resulting from the construction of the aforesaid facilities and will replace the same in as good condition as existed prior to the construction work.
(5)
This franchise shall continue in full force and effect for a period of ninety-nine (99) years from and after the date of the adoption of this ordinance [section].
