§ 7-70. Brown Paper Mill Co., Inc.

    There is hereby granted to the Brown Paper Mill Company, Inc., a corporation organized and created under the laws of the State of Delaware, its successors and assigns, a right and privilege to construct, operate and maintain in, over, along, under and across the public highways and levees of the Parish of Ouachita, Louisiana, two (2) water pipe lines not over twenty-four (24) inches in diameter and a line for the transmission of electrical energy as shown in red on the plat attached hereto and made a part hereof.

    (2)

    This ordinance [section] is issued under and by virtue of the various acts of the Legislature of the State of Louisiana, authorizing the police juries of the parishes of said state to grant franchises for the crossing and paralleling of the roads, highways and levees of the various parishes and where said pipe lines, communication lines and lines for the transmission of electrical energy cross state highways, they shall be governed by the provisions of the state highways acts applicable thereto, and where they cross or run along levees, they shall be governed by the provisions of the laws applicable thereto.

    (3)

    As to any parish road crossed and paralleled by said pipe lines, communication lines and lines for the transmission of electrical energy, the parish, through its parish engineer, before said crossings are installed, may require that same be constructed in accordance with the requirements adopted by the director of highways of the State of Louisiana with respect to state highways.

    (4)

    The grantee herein named in accepting this franchise agrees and guarantees to hold harmless the police jury of the Parish of Ouachita, Louisiana, and its individual members from any and all loss, damages or expense which they may suffer on account of the granting of this franchise and privilege and operations thereunder arising from any cause whatsoever in favor of any person, persons, partnership or corporation, and further agrees that any damage done by grantee in construction, operation or maintenance of the above lines shall be repaired at the expense of the grantee.

    (5)

    This franchise shall continue in full force and effect for a period of ninety-nine (99) years from and after the date of the adoption of this ordinance [section].
