§ 7-81. Swartz Waterworks, Inc.

  • (1)

    There is hereby granted to Swartz Waterworks, Inc., its successors and assigns (herein called grantee), a franchise consenting and authorizing grantee's use of such of the public roads, streets, alleys, highways, thoroughfares and public areas in this parish, located within the following described limits:

    Beginning at a point 200 feet due south of the southwesterly corner of the westerly end of the Broadnax Road; go thence in an easterly direction, crossing the Walker Road at a point 300 feet south of the easterly end of Broadnax Road, to a point 2000 feet due east of the point where the said line crosses the easterly right-of-way line of the Walker Road; go thence due north from said point, crossing La. Highway 139 (Old Monroe-Bastrop Road), to a point 500 feet due east of the most northeasterly portion of Vinwood Subdivision; go thence in a westerly direction to a point 3000 feet due west from the most northeasterly portion of Vinwood Subdivision; go thence in a southerly direction in a straight line to the northeasterly edge of a bridge just southwest of Canterberry Road; crossing La. Highway 139 (Old Monroe-Bastrop Road), and thence continue from said bridge in a southerly direction in a straight line to the point of beginning;

    Particularly including the following:

    (a)

    Louisiana Highway 139 (Old Monroe-Bastrop Road) from the bridge just southwest of Canterberry Road to a point thereon 528 feet east of Vinwood Subdivision;

    (b)

    Vinwood Road;

    (c)

    Canterberry Drive;

    (d)

    Broadnax Road;

    (e)

    Wuichet Road;

    (f)

    Delrey Road;

    (g)

    Walker Road from its intersection with Louisiana Highway 139 (Old Monroe-Bastrop Road) in a southerly direction to a point 300 feet south of the southerly edge of Broadnax Road.

    For the purpose of installing, maintaining, operating, expanding, renewing, repairing and removing water mains, water pipes and other equipment and appurtenances employed to furnish water to individuals in this parish for a term of fifty (50) years from this date.

    (2)

    This franchise shall be exclusive within the boundaries as above set forth, provided, however, that the rights herein conferred shall not be exercised in, over or upon thoroughfares or rights-of-way now officially included within the state highway system, without the consent of the proper state authorities.

    (3)

    All such water mains, water pipes, equipment and appurtenances shall be installed so as to interfere as little as possible with traffic and in accordance with the rules and regulations and specifications of the Ouachita Parish police jury and thoroughfares restored promptly to their former condition of usefulness.

    (4)

    Grantee shall reimburse the parish for all damages sustained by it by reason of this franchise and if grantee shall fail to complete any restoration work promptly or in a workmanlike manner, this parish and its officers shall have the right to do such work at grantee's expense and grantee shall reimburse the parish forthwith for all reasonable costs so incurred.
