§ 7-109. Agreement with Greater Ouachita Water Co. ratified and amended.

(1)

The president of the police jury is hereby authorized and instructed to enter into a contract and agreement with Greater Ouachita Water Company ratifying and affirming its contract with the police jury of the Parish of Ouachita, Louisiana, dated June 12, 1963, which is part of ordinance No. 7151 on file in the office of the secretary of the police jury [being section 7-108 hereof] and which is by reference made a part hereof, and to continue said agreement in effect so long as a water, sewerage or other utility is operated by Greater Ouachita Water Company.

The president of the police jury is authorized to enter into an act amending paragraph 13 of the contract between said police jury and Greater Ouachita Water Company, dated June 12, 1963, and in its place and stead to substitute the following new paragraph in lieu of the old one;

"13. That this permit and agreement shall become effective upon the date the company acquires a water, sewerage or other utility system and executes a contract for the construction and improvement of said system or systems so purchased, provided that if a water, sewerage or other utility system is not purchased, and if the company does not begin construction work for the improvement of said water, sewerage or other utility system within 24 months from this date, or on or before June 12, 1965, or if the company has not acquired a water, sewerage or other utility system within the Parish of Ouachita, Louisiana, by June 12, 1965, this permit and agreement shall ipso facto, without demand or putting into default, become void, and shall be without any legal efficacy or effect whatever."

A copy of the amendment to be executed by the president of the police jury in compliance with this ordinance [section] is annexed hereto and made a part hereof.
