    PREFACE

    This volume constitutes a Compilation of the ordinances of the police jury of a general and permanent nature. Some resolutions of general and permanent nature have also been included. Actions of a special or limited interest, such as authorizing bond issues, levying annual taxes, making appropriations, etc., are not included herein.

    The chapters of the Compilation have been conveniently arranged in alphabetical order and the various sections within each chapter have been appropriately catchlined to facilitate usage. Appropriate footnotes which tie related sections of the Compilation together and which refer to relevant state laws have been included. Also, the source of each section is included in the history note appearing in parentheses at the end thereof.

    The numbering system used in this Compilation is the same system used in many state codes. Each section number consists of two parts separated by a dash, the figure before the dash referring to the chapter number and the figure after the dash referring to the position of the section within the chapter. Thus, the first section of Chapter 1 is numbered 1-1 and the fourteenth section of Chapter 20 is 20-14.

    A special feature of this Compilation is the looseleaf system of binding and supplemental servicing. With this looseleaf system, the Compilation will be kept up-to-date periodically. Upon the final passage of ordinances, they will be properly edited and the page or pages affected will be reprinted. These new pages will be distributed to the holders of the Compilation with instructions for the manner of inserting the new pages and deleting the obsolete pages.

    The successful maintenance of this Compilation up-to-date at all times will depend largely upon the holder of the volume. As revised sheets are received it will become the responsibility of the holder to have them inserted according to the attached instructions. It is strongly recommended by the publishers that all such additions be inserted immediately upon receipt to avoid misplacing them and, in addition, that all deleted pages be saved and filed for historical reference.

    The general index to the Compilation has been prepared with the greatest of care. Each item has been placed under several headings, some of the headings being couched in lay phraseology, others in legal terminology, and still others in language generally used by parish officials and employees. There are numerous cross references within the index itself which stand as guideposts to direct the user to the particular item in which he is interested.

    The publication of this Compilation was under the direct supervision of George R. Langford, President, and C. Julian Manson, Editor, of Municipal Code Corporation, Tallahassee, Florida. Credit is gratefully given to the other members of the publisher's staff for their sincere interest and able assistance throughout the project.

    The publishers are most grateful to all parish officers for their interest and cooperation in the preparation of this Compilation. Special acknowledgment is made to Mr. Albin P. Lassiter, District Attorney, Mr. Robert W. Ksotelka, Assistant District Attorney, and Miss Nell Cheek, Parish Secretary, for their advice and assistance.

    This Compilation is presented for the use and benefit of the citizens of Ouachita Parish.

    ORDINANCE NO. 7187

    An Ordinance Adopting and Enacting a Compilation of the Ordinances of a General and Permanent Nature of the Parish of Ouachita; Repealing Certain Ordinances not Included Therein; Providing for Custody of Said Compilation; and Prohibiting Altering Said Compilation.

    Be It Ordained by the Police Jury of the Parish of Ouachita, State of Louisiana, In Legal Session Convened:

    Section 1. That the Police Jury hereby adopts and enacts that certain publication in looseleaf book form entitled "Compiled Ordinances, Parish of Ouachita, Louisiana," and said Compilation shall be treated and considered as a new and original comprehensive ordinance which shall supersede all general and permanent ordinances passed by the Police Jury on or before May 17, 1965, except such as by reference thereto are expressly saved from repeal or continued in force and effect for any purpose.

    Section 2. That said Compilation shall become effective sixty (60) days after the adoption of this Ordinance, and all ordinances of a general and permanent nature of the Parish of Ouachita, enacted on or before May 17, 1965, and not contained in such Compilation or recognized and continued in force by reference therein are expressly repealed from and after the effective date of said Compilation.

    Section 3. That the repeal provided for in Section 2 shall not affect the following types of ordinances:

    (1)

    Accepting, abandoning, naming, establishing, locating, relocating, paving or improving any road, public way or servitude in the Parish;

    (2)

    Adopting or amending any budget or making any appropriations;

    (3)

    Levying annual taxes;

    (4)

    Relating to any special assessment or local improvement;

    (5)

    Prohibiting or restricting the sale of alcoholic beverages or intoxicants in a particular ward;

    (6)

    Authorizing the execution of any document;

    (7)

    Promising or guaranteeing the payment of money by or to the Parish, or authorizing the issuance of any bonds or other evidence of indebtedness;

    (8)

    Pertaining to any specific election;

    (9)

    Providing for the compensation of Parish officers or employees;

    (10)

    Relating to franchises, not inconsistent with said Compilation;

    Nor shall such repeal be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this Ordinance; nor shall such repeal affect any punishment or penalty incurred before the repeal took effect, nor any suit, prosecution, or proceeding pending at the time of the repeal.

    Section 4. That a copy of such Compilation shall be kept on file in the office of the Parish Secretary preserved in looseleaf form, or in such other form as the Parish Secretary may consider most expedient. It shall be the express duty of the Parish Secretary or someone authorized by him, to insert in their designated places all amendments or ordinances which indicate the intention of the Police Jury to make the same a part of such Compilation when the same have been printed or reprinted in page form, and to extract from such Compilation all provisions which may be from time to time repealed by the Police Jury. This copy of such Compilation shall be available for all persons desiring to examine the same.

    Section 5. That it shall be unlawful for any person to change or alter by additions or deletions, any part or portion of such Compilation, or to insert or delete pages or portions thereof, or to alter or tamper with such Compilation in any manner whatsoever which will cause the law of the Parish of Ouachita to be misrepresented thereby. Any person violating this section shall be punished by a fine not exceeding one hundred dollars ($100.00) or by imprisonment for not exceeding thirty (30) days, or both such fine and imprisonment, in the discretion of the court.

    Section 6. That all ordinances or parts of ordinances in conflict herewith, are, to the extent of such conflict, hereby repealed.

    The above ordinance having brought to a vote, the vote thereon resulted as follows:

    An Ordinance Adopting and Enacting a Compilation of the Ordinances of General and Permanent Nature of the Parish of Ouachita, State of Louisiana; Repealing Certain Ordinances not Included Therein; Providing for the Custody of Said Compilation; Prohibiting the Alteration of Said Compilation; Providing for the Manner and Method of Amending said Compilation and Repealing all Ordinances or Parts of Ordinances in Conflict Herewith.

    BE IT ORDAINED by the Police Jury of the Parish of Ouachita in regular and legal session convened:

    Section 1. The Police Jury of the Parish of Ouachita hereby adopts and enacts that certain publication in looseleaf book form entitled "Compiled Ordinances, Parish of Ouachita, Louisiana", and said Compilation shall be treated and considered as new and original comprehensive ordinances which shall supersede all general and permanent ordinances passed by the Police Jury on or before the 30th day of June, 1976, except such as by reference therein are expressly saved from repeal or continued in force and effect for any purpose.

    Section 2. Said Compilation shall become effective sixty (60) days after the adoption of this Ordinance and all ordinances of general and permanent nature of the Parish of Ouachita, State of Louisiana, enacted on or before the 30th day [of] June, 1976 and not contained in such Compilation or recognized and continued in force by reference therein are expressly repealed from and after the effective date of said Compilation.

    Section 6. It shall be unlawful for any person to change or alter by additions or deletions any part or portion of such Compilation, or to insert or delete pages or portions therefrom, or to alter or tamper with such Compilation in any manner whatsoever which will cause the law of the Parish of Ouachita to be misrepresented thereby. Any person violating this section shall be punished by a fine of not exceeding One Hundred and No/100 Dollars ($100.00) or by imprisonment not exceeding thirty (30) days, or both such fine and imprisonment, at the discretion of the court.

    Section 7. That all ordinances or parts of ordinances in conflict herewith, are to the extent of such conflict, hereby repealed.

    The above ordinance having been brought to a vote, the vote thereon resulted as follows:

    YEAS: 6, Messrs. Rawls, Banks, Downing, Pierce, Crain and Wilhite.

    NAYS: 0

    ABSENT: 0

    The above Ordinance adopted this 19th day of July, 1976.
