§ 15-23. Automatic temporary ban on open-air burning upon state ordered burn ban.
(a)
In the unincorporated areas of Ouachita Parish no person shall conduct the open-air burning of any trash, garbage, leaves, limbs and branches, or debris of any kind when such burning is prohibited by a burn ban ordered by the Louisiana Fire Marshall, the Secretary of the Louisiana Department of Agriculture and Forestry, and/or the Governor.
(b)
A burn ban affected by this section shall not apply to any person conducting open-air burning pursuant to a license or permit issued by the Louisiana Department of Agriculture and Forestry, the Louisiana Department of Environmental Quality, or the Fire Chief of Ouachita Parish Fire Protection District No. 1.
(c)
A burn ban affected by this section shall not apply to the discharge of fireworks.
(d)
Any person violating the provisions of this section shall be punished by a fine of not more than five hundred dollars ($500.00) or imprisoned for a term of not more than thirty (30) days.
(e)
As an alternative to any other available enforcement mechanism or procedure, this section may be enforced through an administrative adjudication by the Ouachita Parish Administrative Hearing Officer pursuant to R.S. 13:2575(B) and Ouachita Parish Police Jury Ordinance No. 8786 (Compiled Ordinances of Ouachita Parish, Section 1-26).
