§ 19-15. Installation of concrete driveways across culverts.

  • (a)

    No concrete driveways shall be constructed across culverts whether for residential or commercial purposes by any agent, department or employee of this police jury except on the approval and direction of the police jury.

    (b)

    No concrete driveway across a culvert, whether installed by agents, departments or employees of this police jury or otherwise shall be maintained by this police jury except upon the approval and direction of the police jury.

    (c)

    No person, firm or corporation shall install any concrete driveway across any culvert within the drainage ditches of the Parish of Ouachita except by authority of a permit issued by the parish engineer.

    (d)

    Any person, firm or corporation desiring to install a concrete driveway across a culvert within the highway rights-of-way of the Parish of Ouachita shall make application on forms to be provided to the parish engineer; the application shall contain a specific and accurate description and location of the place at which the concrete driveway across a culvert is to be installed; when the permit is issued, survey crews of the Department of Highways shall inspect the site and shall determine whether the culvert has been installed in accordance with the provisions of Ouachita Parish Ordinance No. 749 [section 19-14] regulating the installation of culverts within the highway rights-of-way of the Parish of Ouachita. Upon completion of said inspection, if the culvert is found to be installed in accordance with the provisions of the above cited ordinance [section 19-14], this fact shall be noted on the back of the permit. If the parish engineer or his agents find the culvert not to have been properly installed, the applicant shall be notified in writing of the deficiency in the installation; said deficiencies shall be corrected in accordance with the above cited ordinance [section 19-14] regulating the installation of culverts within parish rights-of-way. When the applicant has properly installed the culverts in accordance with the above cited ordinance [section 19-14] and the same has been approved by the parish highway department, then and in that event, construction of the concrete driveway across the culvert shall be permitted, in accordance with specifications provided below.

    (e)

    Any person violating the terms of this section shall be guilty of a misdemeanor and upon conviction fined no more than one hundred dollars ($100.00) or imprisoned for not more than thirty (30) days, or both.
